PLEASE READ THESE TERMS OF SERVICE ("TERMS") AS THESE TERMS CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

THE PHYSIQUE WAREHOUSE may revise and update these Terms at any time. Your continued use of the Services will mean you accept the revised Terms.

  1. IMPORTANT DISCLAIMER. THE INFORMATION PROVIDED THROUGH THIS SITE ASSOCIATED GROUPS OR SENT TO YOU BY A THE PHYSIQUE WAREHOUSE REP IS INTENDED TO ASSIST YOU IN YOUR GYM FITNESS EXPERIENCE. YOU AGREE AND ACKNOWLEDGE THAT THE PHYSIQUE WAREHOUSE IS NOT A MEDICAL ORGANIZATION, HOSPITAL OR STAFFED BY MEDICALLY TRAINED PERSONNEL. BEFORE YOU BEGIN ANY FITNESS OR NUTRITION PROGRAM, CONSULT YOUR PHYSICIAN TO DETERMINE IF YOU ARE ABLE TO ATTEND THE GYM. DO NOT START A FITNESS OR NUTRITION PROGRAM IF YOUR PHYSICIAN ADVISES AGAINST IT. PLEASE NOTE THAT THE COACHES, TRAINERS, AFFILIATES OR EMPLOYEES CANNOT PROVIDE YOU WITH MEDICAL ADVICE AND NOTHING THAT YOU MAY READ ON THIS SITE OR THAT IS OTHERWISE PROVIDED TO YOU BY THE COACHES, TRAINERS, AFFILIATES OR EMPLOYEES SHOULD BE CONSTRUED AS SUCH. ALTHOUGH THE PHYSIQUE WAREHOUSE  AND THE SITE’S TRAINERS, AFFILIATES AND EMPLOYEES MAKES AN EFFORT TO PROVIDE QUALITY INFORMATION TO YOU, THE PHYSIQUE WAREHOUSE DISCLAIMS ANY IMPLIED GUARANTEE REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELEVANCE OF ANY INFORMATION PROVIDED THROUGH THIS SITE OR AT THE GYM. FOR EXAMPLE, HEALTH, DIET & FITNESS ADVICE IS OFTEN SUBJECT TO UPDATING AND REFINING DUE TO MEDICAL RESEARCH AND DEVELOPMENTS. NO ASSURANCE CAN BE GIVEN THAT THE INFORMATION PROVIDED THROUGH THIS SITE WILL REFLECT THE MOST RECENT FINDINGS OR DEVELOPMENTS WITH RESPECT TO THE PARTICULAR MATERIAL. THE SITE IS INTENDED FOR MAINLY INFORMATIONAL PURPOSES FOR THE GENERAL PUBLIC INTERESTED IN THE SERVICES THAT THE PHYSIQUE WAREHOUSE CAN PROVIDE.
  2. Registration. In order to obtain a membership, you must provide The Physique Warehouse with certain personal information. The gym respects your privacy, and a complete statement of the gym’s current privacy policy can be found below. The gym’s privacy policy is expressly incorporated into these Terms by this reference. It is imperative that you provide accurate and truthful information about your health and physical condition during the registration process. In becoming a member with the intent of using a fitness or nutrition program, you represent and warrant to The Physique Warehouse that all the personal information you provided during the registration process is true and correct. THE PHYSIQUE WAREHOUSE RESERVES THE RIGHT TO REFUSE OR CANCEL YOUR MEMBER STATUS OR USE OF THE SERVICES IF WE DETERMINE THAT YOU HAVE OR IF YOU INFORM US THAT YOU HAVE CERTAIN CONDITIONS. THE PHYSIQUE WAREHOUSE RESERVES THE RIGHT TO CANCEL YOUR MEMBER STATUS SHOULD YOU VIOLATE THESE TERMS AND ANY OTHER POSTED POLICY ON THE SITE.
  3. Fees.  Our features, such as the ability to use equipment based at the gym, require you to pay a fee. You agree to pay the fees and any other charges incurred in connection with your username and password (including any applicable taxes) at the rates in effect when the charges were incurred. The Site uses Gocardless/Stripe to process your credit card transactions. We will bill all charges automatically to your credit card or Stripe account. Your initial subscription fees will be billed at the beginning of your subscription. Renewal fees will be billed on a weekly, monthly, or annual basis dependent on the length of your subscription. All fees and charges are non-refundable, except in instances where we are unable or unwilling to provide the requested services. We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance.
  4. Renewal/Refunds/Cancellations. Following the end of your initial program term, your program will be changed to a monthly recurring subscription and will be AUTOMATICALLY RENEWED. Unless we terminate it, you must give a minimum 30 days’ notice to cancel your subscription by notifying us by email at info@thephysiquewarehouse.co.uk (receipt of which must be confirmed by email reply from us) of your decision to terminate your subscription in 30 days. Cancellations of less than 30 days will not be accepted and any billing periods within that 30 days remain active and are due upon renewal and are non-refundable.
  5. Indemnity.  All users herein agree to insure and hold The Physique Warehouse, our subsidiaries, affiliates, agents, employees, officers, partners and/or licensors blameless or not liable for any claim or demand, which may include, but is not limited to, reasonable attorney fees made by any third party which may arise from injuries that may occur during their time within the gym, the gym user is responsible for being confident in using the equipment before they do so.
  6. Age Limitations. Use of the gym is limited to individuals 16 years of age or older. Your use of the gym affirms that you are at least 16 years of age, which must be declared on signing up at reception.
